Lawsuit: Chevron Phillips' flood prevention project source of flooding in nearby subdivision

HOUSTON – Irony is when something intended to solve a problem creates one itself.

Baytown residents Albert and Samantha Zamarron’s lawsuit against Chevron Phillips Chemical Co., LP alleges the petrochemical company embarked on a U.S. Gulf Coast Petrochemicals project to control and prevent flooding at its Cedar Bayou facility, but caused flooding headaches for the Zamarrons and the residents of the adjacent Harvest Meadows subdivision.

The suit, which was filed on Mar. 20 in the Harris County 215th District Court, claims Chevron Phillips failed to fix the problems at issue, stating they culminated with the landfall of Hurricane Harvey last August.

The Cedar Bayou facility was reportedly spared while the plaintiffs and the Harvest Meadows residents endured substantial flooding.

According to the Zamarrons, they also suffered property damage, decreased property value, and a loss of their vehicles.

The defendant admitted its fault and attempted to purchase homes in the subdivision, but it “offered less than market value for those homes, and only offered to purchase the homes at their reduced post-flooding price,” the complaint says.

Consequently, the Zamarrons seek unspecified monetary damages.
