SHERMAN – A Frisco consumer alleges she has been harassed by calls from a debt collector.
Dawn M. Clark filed a complaint on March 29 in the Sherman District of the Eastern District of Texas against AllianceOne Receivables Management Inc. alleging that the debt collector violated the Telephone Consumer Protection Act and the Texas Debt Collection Act.
According to the complaint, the plaintiff alleges that in 2017, she began receiving calls to her cellphone from defendant attempting to collect upon an alleged debt. She alleges she asked the defendant to stop calling her but it continued to do so.
As a result of defendant's allegedly unlawful conduct, the plaintiff claims she suffered invasion of privacy, aggravation, emotional distress, increased risk of personal injury resulting from the distraction, increased usage of her telephone services and loss of cellular phone capacity.
The plaintiff holds AllianceOne Receivables Management Inc. responsible because despite her demands to stop calling her, the defendant allegedly continued to call her and used an automatic telephone dialing system.
The plaintiff requests a trial by jury and seeks damages of at least $500 per phone call, treble damages, costs and reasonable attorney fees and such other just and appropriate relief.
