Individual seeks more than $200,000 from Hardwood Specialty Products after he was struck by forklift

HOUSTON – An individual claims that a forklift driver failed to yield and struck him while he was in a Houston warehouse.

James Netherly filed a complaint on March 30 in the Harris County District Court against Hardwood Specialty Products USPG Inc. alleging negligence.

According to the complaint, the plaintiff alleges that on June 1, 2016, he was standing in defendant's warehouse when its employee turned his forklift, struck the plaintiff and ran over his foot. He alleges as a result, he received serious injuries resulting in pain and suffering, physical impairment, disfigurement, medical expenses and lost wages. 

The plaintiff holds Hardwood Specialty Products USPG Inc. responsible because defendant's employee allegedly failed to keep a proper lookout and failed to yield to individuals.

The plaintiff seeks monetary relief of more than $200,000 but not more than $1 million and such other lawful and equitable relief. He is represented by Jared B. Ynigez of The Law Office of Jared B. Ynigez PLLC in Houston.
