Palms on Westheimer tenant alleges staircase caused fall

HOUSTON – A tenant of a Houston apartment complex alleges a faulty staircase caused him to fall.

Jeffrey Sherbourne filed a complaint on April 5 in the Harris County District Court against the Palms on Westheimer, WOP Palms LLC, et al. alleging premises liability.

According to the complaint, the plaintiff alleges that on May 1, 2016, he was seriously injured when he fell down a flight of stairs at the defendants' The Palms on Westheimer apartments that were improperly maintained by defendants. He alleges he suffered injuries that resulted in medical expenses, lost wages, pain and suffering and disfigurement. 

The plaintiff holds The Palms on Westheimer, WOP Palms LLC, et al. responsible because the defendants allegedly failed to inspect the premises and make the dangerous conditions safe and failed to provide warnings that such a danger existed.

The plaintiff seeks monetary relief of more than $200,000 but not more than $1 million and such other lawful and equitable relief. He is represented by Paul A. Higdon and J. Kevin Shaw of Higdon Lawyers in Houston.
