MARSHALL – A motorist is seeking damages from a Florida man and his Nebraska employer over a collision in Titus County.
John Wells filed a complaint on April 9 in the Marshall Division of the Eastern District of Texas against the Ameri-Co Carriers Inc. and Harry John Baccaire alleging negligence.
According to the complaint, the plaintiff alleges that on April 11, 2016, he was injured when the Freightliner tractor-trailer driven by defendant Baccaire, who was employed by defendant Ameri-Co, struck the Nissan Frontier he was driving. The suit states the collision occurred on U.S. Highway 271.
The plaintiff alleges he suffered injuries that resulted in pain and suffering, mental anguish, medical expenses and loss of earning capacity.
The plaintiff holds Ameri-Co Carriers Inc. and Baccaire responsible because defendant Baccaire allegedly negligently attempted to pass on the left when it was not safe to do so and failed to keep a proper lookout.
The plaintiff requests a trial by jury and seeks actual damages, post-judgment interest, costs, fees and other expenses and any further relief to which he may be entitled. He is represented by Brent Goudarzi and Marty Young of Goudarzi & Young LLP in Gilmer.
