Buyer alleges Loftech Homes failed to remedy water penetration issues in house

HOUSTON – A Harris County man alleges that the seller of his home misrepresented that repairs had been completed on the house to address water penetration issues.

Jeffrey Spencer filed a complaint on April 10 in the Harris County District Court against Loftech Homes LLC alleging violation of the Deceptive Trade Practices Act, fraud in a real estate transaction and other counts.

According to the complaint, the plaintiff alleges that on April 26, 2016, he purchased a new home from the defendant. He alleges prior to closing on the home, an inspection revealed water penetration in the master bedroom. He alleges the defendant represented to him that it remedied the issue but that this was false.

The plaintiff holds Loftech Homes LLC responsible because the defendant allegedly falsely represented that the home was habitable and ready for occupancy and failed to address the water penetration at plaintiff's home.

The plaintiff requests a trial by jury and seeks monetary damages of more than $200,000 but not more than $1 million and such other and further relief. He is represented by Patrick B. Larkin of The Larkin Law Firm PC in Pearland.
