HOUSTON – A restaurant chain alleges it was damaged when an Illinois individual failed to honor a commitment.
Berryhill Hot Tamales Corp. filed a complaint on April 7 in the Harris County District Court against Henry Leong, et al. citing the Texas Deceptive Trade Practice and Consumer Protection Act.
According to the complaint, the plaintiff alleges that in December 2016, the plaintiff advanced more than $46,000 to defendants to secure and consummate $20 million in financing to expand Berryhill Baja Grill locations. The plaintiff alleges the defendants never honored the confirmed loan commitment.
The plaintiff holds Leong, et al. responsible because the defendants allegedly actively concealed, failed to disclose or intentionally or negligently misrepresented the material facts of and concerning the subject financing and their true credentials and licensing.
The plaintiff seeks actual, incidental and consequential damages; pre- and post-judgment interest; attorney's fees; costs and such other lawful and equitable relief. It is represented by Gregg Dasher of Dasher Law Offices in Houston.
