UP International Inc. alleged to have failed to pay inspector overtime pay

GALVESTON – A Harris County man formerly employed as an inspector for an oil and gas company alleges he was not paid overtime wages.

Richard Navarro, individually and on behalf of all others similarly situated, filed a complaint on April 10 in the Galveston Division of the Southern District of Texas against UP International Inc. alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff worked for the defendant during various periods from 2011 to 2016. He alleges that he usually worked more than 40 hours per week with defendant without receiving overtime compensation for all hours worked in excess of 40 hours per week. He alleges he was paid on a day-rate basis without overtime.

The plaintiff holds UP International Inc. responsible because the defendant allegedly knowingly and deliberately failed to compensate him for his overtime hours at a rate of time-and-one-half of his regular rate of pay as required under the FLSA.

The plaintiff requests a trial by jury and seeks all unpaid overtime compensation, liquidated damages, attorney’s fees, costs, expenses and such other and further relief. He is represented by Beatriz-Sosa Morris and John Neuman of Sosa-Morris Neuman PLLC in Houston.
