HOUSTON – A man formerly employed as a dispatcher alleges his employer failed to compensate him for overtime work.
Burr Baker filed a complaint on April 12 in the Houston Division of the Southern District of Texas against Star Houston Inc. alleging violation of the Fair Labor Standards Act.
According to the complaint, the plaintiff was employed by the defendant from April 2014 to January 2018 as a dispatcher. He alleges that he worked approximately 48 hours and 45 minutes per week for the defendant without receiving premium pay for all hours worked over 40 as required by the FLSA. Instead, he alleges he was paid on a salary-rate basis.
The plaintiff holds Star Houston Inc. responsible because the defendant allegedly failed to properly compensate him for works performed in excess of 40 hours per week.
The plaintiff requests a trial by jury and seeks unpaid overtime wages, liquidated damages, prejudgment interest, costs and attorney’s fees and such other just and equitable relief. He is represented by Josef F. Buenker and Thomas H. Padgett Jr. of The Buenker Law Firm in Houston.
