Odebrecht Construction Inc., Zachry Construction Corp. alleged to have manipulated payroll records

HOUSTON – Employees of a Coral Gables, Florida and San Antonio construction companies allege that their payroll records were manipulated and that they are owed unpaid wages.

Federico Villegas-Rivas, et al. filed a complaint on April 13 in the Houston Division of the Southern District of Texas against Odebrecht Construction Inc. and Zachry Construction Corp. alleging that they violated the Fair Labor Standards Act.

According to the complaint, the plaintiffs were employed as working foremen by the defendants and regularly worked more than 40 hours per week.

The plaintiffs hold Odebrecht Construction Inc. and Zachry Construction Corp. responsible because the defendants allegedly manipulated their payroll records to make it appear as if they were properly paid, but they were actually paid a flat salary for the first 50 hours and straight time for those hours worked over 50 a week.

The plaintiffs request a trial by jury and seek unpaid overtime wages, liquidated damages, attorney’s fees, costs and such other and further relief. They are represented by Alfonso Kennard Jr. and Keenya Harrold of Kennard Richard PC in Houston.
