Customer alleges Darryl & Co. failed to provide mock-up, return deposit

HOUSTON – A Houston event design and rental company is alleged to have stopped communicating with a customer and failed to return his deposit.

Carlos Paez filed a complaint on April 13 in the Harris County District Court against Darryl Murchison, doing business as Darryl & Co., alleging breach of contract.

According to the complaint, the plaintiff alleges that on July 19, 2017, the plaintiff contracted defendant for the design and delivery of floral arrangements for his daughter's wedding ceremony and wedding reception and provided a check deposit for $10,042.49. He alleges he was dissatisfied with the first mock-up of the design the defendant provided and requested a second, which was never completed. He alleges the defendants ceased communicating with him and he had to secure a new vendor.

The plaintiff holds Murchison responsible because the defendant allegedly failed to provide a mock-up that would comply with the contract and as requested and refused to return plaintiff's deposit.

The plaintiff seeks actual, statutory and exemplary damages, pre- and post-judgment interest, costs, attorney's fees and such other and further relief. He is represented by Stephen H. Lee and Katelin E. Cox of Porter Hedges LLP in Houston.
