ESPN, Chick-Fil-A face copyright infringement suit over use of song in commercials

DALLAS – Platinum Jack Entertainment, LLC accuses ESPN and Chick-Fil-A of using a musical composition it reportedly owns in a commercial.

A copyright lawsuit filed on Apr. 10 in the Dallas Division of the Northern District of Texas alleges the defendants infringed on a song called “Best I Had” performed by the band Drayter.

Court papers explain that the plaintiff learned about the act in question last fall, stating a “substantial” portion of “Best I Had” was illegally used in ads entitled “ESPN: Halftime Report, Featuring Joey Galloway” and “ESPN: Hurricane Harvey Relief, Featuring Joey Galloway.”

“The defendants do not have any license, authorization, permission or consent to use the infringed composition,” the original petition says.

Consequently, Platinum Jack seeks unspecified monetary damages and a jury trial.

It is represented by Ross Cunningham and Alex J. Whitman of the law firm Cunningham Swaim, LLP in Dallas.
