HOUSTON – A consumer claims a Washington-based debt collector has invaded her privacy with collection calls.
Christina M. James filed a complaint on April 19 in the Houston Division of the Southern District of Texas against Convergent Outsourcing Inc. alleging violation of the Texas Debt Collection Act and the Telephone Consumer Protection Act.
According to the complaint, the plaintiff alleges that in November 2017, she began receiving calls to her cellular phone from defendant claiming that she owes $695 to PayPal Inc. She alleges the defendant harassed her with calls and invaded her privacy. She also alleges she never provided her number to the defendant.
The plaintiff holds Convergent Outsourcing Inc. responsible because the defendant allegedly placed no less than 41 harassing phone calls through the present day, called several times in one day and on weekends using an automated telephone dialing system.
The plaintiff requests a trial by jury and seeks statutory damages of at least $500 per phone call, actual and treble damages, attorney fees, costs and any other relief that is just and appropriate.
