Beaumont Independent School District alleged to have retaliated against employee after on-the-job injury

BEAUMONT – A woman is seeking reinstatement to her position at Beaumont Independent School District and alleges she was discriminated against because of a disability.

Rose Wilson filed a complaint on March 29 in the Jefferson County District Court against Beaumont Independent School District alleging discrimination and retaliation, interference with Family and Medical Leave Act rights and failure to accommodate.

According to the complaint, the plaintiff was hired by the defendant as a public safety officer in February 2009 and was injured on the job in September 2016. She alleges was unable to return to work until March 2017 and that the defendant informed her she could not return to work because it could not accommodate her restrictions. The suit states she was terminated in May 2017.

The plaintiff holds Beaumont Independent School District responsible because the defendant allegedly intentionally discriminated against her because of her disability and deprived her of equal employment opportunities.

The plaintiff seeks actual damages, compensatory damages, liquidated damages, reinstatement, costs of court, pre- and post-judgment interest at the maximum rate allowed by law; reasonable and necessary attorneys' fees. She is represented by David J. Manley of David J. Manley in Houston.
