Columns on 59 tenant alleges she needed surgery after fall because of unsecured flooring

HOUSTON – A tenant of a Houston apartment alleges that she fell because concrete had been removed from the flooring and the area was not roped off.

Gustina Hayward filed a complaint on April 24 in Harris County District Court against Columns on 59 alleging negligence.

According to the complaint, the plaintiff alleges that on Nov. 19, she was walking down the breezeway of her apartment on Columns on 59 when she fell approximately 8 to 10 feet to the ground. The suit states the concrete floor had been removed and replaced by a sheet of drywall that was not secured or roped off. She alleges she sustained injuries and was required to undergo surgery to relieve the pain. 

The plaintiff holds Columns on 59 responsible because the defendant allegedly failed to warn of the condition.

The plaintiff seeks monetary relief of more than $200,000 but not more than $1,000,000. She is represented by David P. Petersen of The Law Offices of David P. Petersen PC in Houston.
