HOUSTON – A Houston man employed by a food market for 22 years alleges he worked four or five additional hours a week without pay.
Fidencio Ramirez filed a complaint on May 4 in the Houston Division of the Southern District of Texas against Randall's Food Markets Inc. and Randall's Food and Drugs LP alleging violation of the Fair Labor Standard Act.
According to the complaint, the plaintiff alleges that between May 1, 2017, and March 27 he worked as the deli manager for defendants' store at Barker Cypress Road in Houston during his two-decade career with the defendants.
The plaintiff alleges that the defendants' store manager at that location imposed a "no overtime" rule on him "while simultaneously subjecting him to unattainable performance goals." He alleges to meet these goals, he worked off the clock and during his lunch break.
The plaintiff holds Randall's Food Markets Inc. and Randall's Food and Drugs LP responsible because the defendants allegedly failed to pay employees at a rate of one-and-one-half times his regular rate of pay for each hour he worked over 40 hours each week and failed to pay the regular hourly rate for each gap-time hour he worked each week.
The plaintiff requests a trial by jury and seeks unpaid regular and overtime wages, liquidated damages, pre- and post-judgment interest, attorneys' fees, costs, and all other relief the court finds proper, whether at law or in equity.
