FedEx Ground contractor alleges barricade at Magnolia Kroger caused him to trip

HOUSTON – A FedEx Ground independent contractor alleges he was injured making a delivery to a Magnolia grocery store because of a hidden safety barricade.

Paul Chiorean filed a complaint on May 11 in the Houston Division of the Southern District of Texas against Kroger Texas LP and The Kroger Co. alleging negligence.

According to the complaint, the plaintiff alleges that on June 3, 2016, he was making a delivery to the Kroger store at 6616 FM 1488, Magnolia and was injured when he tripped over a safety barricade that was concealed. He alleges suffered severe physical injuries resulting in physical pain and suffering, disfigurement, lost wages and medical expenses as a result of the incident. 

The plaintiff holds Kroger Texas LP and The Kroger Co. responsible because defendants' employee allegedly failed to raise the safety barricade or warn him of the tripping hazard.

The plaintiff requests a trial by jury and seeks compensatory damages of more than $75,000, with interest, costs of court and all other relief to which he is justly entitled. He is represented by J. Robert Black of Black Law PC in Houston.
