Man claims ProCollect keeps calling to collect alleged debt owed by unknown third party

HOUSTON – A man alleges he is being harassed by a debt collector in its attempt to collect an alleged debt from an unknown third party.

Bobby V. Grissom filed a complaint on May 15 in the Houston Division of the Southern District of Texas against ProCollect Inc. alleging that the debt collector violated the Fair Debt Collection Practices Act and the Telephone Consumer Protection Act.

According to the complaint, the plaintiff alleges that in September 2017, he changed his cellphone number and immediately began receiving calls from defendant attempting to collect an alleged debt for a Linda K. Schueller. He alleges in October 2017, he informed the defendant's representative that he is not Schueller, does not know her, and asked for the calls to cease. He alleges since asking for the calls to stop, the defendant has contacted him 43 times.

The plaintiff holds ProCollect Inc. responsible because the defendant allegedly used unlawful debt collection practices for a debt that never belonged to him.

The plaintiff requests a trial by jury and seeks statutory and actual damages, attorney fees, costs and all other relief that is just and proper. He is represented by Marwan R. Daher and Omar T. Sulaiman of Sulaiman Law Group LTD in Lombard, Illinois.
