Credito Royal USA Finance alleged to have invaded woman's privacy with collection calls

HOUSTON – A Florida debt collector is alleged to have invaded a consumer's privacy with its collection calls.

Victoria Hall filed a complaint on May 15 in the Houston Division of the Southern District of Texas against Credito Royal USA Finance LLC, doing business as AFS Acceptance LLC, alleging that the debt collector violated the Telephone Consumer Protection Act and the Texas Deceptive Trade Practices Act.

According to the complaint, the plaintiff alleges that after falling behind on her payment towards an automobile loan, defendant began placing numerous calls and sending multiple text messages to her cellular phone. She alleges she asked the defendant to stop contacting her on her cellphone but the phone calls continued. 

As a result of defendant's alleged conduct, she claims she has suffered an invasion of privacy, aggravation, emotional distress and increased risk of personal injury resulting from the distraction. 

The plaintiff holds Credito Royal USA Finance LLC responsible because the defendant allegedly continued to place calls to her cellular phone even after her request to stop contacting her and made calls using an automatic telephone dialing system.

The plaintiff requests a trial by jury and seeks damages of at least $500 per phone call, treble damages, costs and attorney fees and any other relief that is just and appropriate. She is represented by Marwan R. Daher and Omar T. Sulaiman of Sulaiman Law Group LTD in Lombard, Illinois.
