Family members of man killed in I-45 crash seek $1 million from Bombshells Houston-South

HOUSTON – The wife and minor children of a man killed in a motorcycle accident are seeking $1 million from a restaurant and bar that served him alcohol before the accident.

Dana Drake, individually and as personal representative of the estate of Marvin Drake III, et al. filed a complaint on May 18 in the Harris County District Court against BMB Dining Services (Fuqua) Inc., doing business as Bombshells Houston-South, and Jane Doe server alleging violation of the Dram Shop Act.

According to the complaint, the plaintiffs allege that on Feb. 16, plaintiffs' decedent Marvin Drake III was a patron at defendants Bombshells Houston-South where he consumed numerous alcoholic beverages that were served to him by Jane Doe. The suit states that he left the defendants' location while intoxicated and was involved in a collision on Interstate 45 that resulted in his death. 

The plaintiffs hold BMB Dining Services (Foqua) Inc. and Jane Doe responsible because the defendants allegedly were negligent in serving alcohol to an intoxicated person.

The plaintiffs request a trial by jury and seek monetary relief of more than $1 million and all other relief to which they may show themselves justly entitled. They are represented by Mark A. Weycer and Jennifer Sheedy of The Weycer Law Firm PC in Bellaire.
