Customers allege RG Home Renovations finished home's construction months past deadline

Contract 09

HOUSTON – A Harris County couple alleges a contractor they hired to build their house finished the project 10 months past the deadline and that the house has numerous defects.

Billy Whitaker and Dina Whitaker filed a complaint on May 22 in the Harris County District Court against RG Home Renovations LLC alleging breach of contract, fraud and other counts.

According to the complaint, the plaintiffs allege that on Aug. 21, 2013, they hired the defendant to build their custom home at 3826 Lakeview Drive in Houston with a pre-construction estimate of $809,650. They allege the defendant did not complete the project on time and charged them more than the estimate provided in the contract.

The plaintiffs hold RG Home Renovations LLC responsible because the defendant allegedly failed to finish the house in a timely manner and that the house was completed with substandard workmanship and numerous defects.

The plaintiffs request a trial by jury and seek actual and exemplary damages, attorney's fees, costs, expenses and such other and further relief to which they are entitled. They are represented by Timothy R. Lankau of Ware, Jackson, Lee, O'Neill, Smith & Barrow LLP in Houston.
