A shocking incident at a prominent retail store has led to a significant legal battle. Tracy Miles Richardson filed a complaint against The Neiman Marcus Group LLC in the District Court of Harris County, Texas, on September 4, 2024.

According to the court documents, Richardson alleges that on June 8, 2023, she was injured while shopping at the Neiman Marcus store located at 2600 Post Oak Blvd in Houston. She claims that a double rack provided by the store collapsed on her foot, causing serious injuries. Richardson argues that the rack was defective and posed an unreasonably dangerous condition which Neiman Marcus either knew or should have known about. Despite this knowledge, the company allegedly failed to warn her or make the condition safe.

Richardson's complaint outlines several accusations against Neiman Marcus. She asserts that the company negligently failed to maintain its premises in a safe manner and did not have adequate policies or procedures to ensure safety. "Defendants do not have in place policies or procedures that require, instruct, or train their employees in making the premises reasonably safe," reads one part of the petition. Additionally, Richardson claims that even if such policies existed, they were not enforced properly.

The plaintiff is seeking monetary relief exceeding $250,000 but not more than $1,000,000 for various damages including past and future medical expenses, physical pain and suffering, mental anguish, loss of earnings and earning capacity, and physical impairment. She is also asking for pre-judgment interest from the date of injury through judgment and post-judgment interest at the legal rate.

Representing Tracy Miles Richardson are attorneys from KGS Law Group: Brandon A. Kinard (State Bar No. 24079744), Abraham Garcia (State Bar No. 24078005), Carlos A.
