Texas Windstorm Insurance alleged to have breached contract with handling of Hurricane Harvey claim

BEAUMONT – A Jefferson County property owner is seeking damages from her insurer over its handling of her claim for damages from Hurricane Harvey.

Chandra Smith filed a complaint on May 18 in the Jefferson County District Court against Texas Windstorm Insurance Association alleging breach of contract and other counts.

According to the complaint, the plaintiff is the named insured under the property insurance issued by defendant. The suit states the plaintiff's home was damaged by Hurricane Harvey in August 2017 and she filed a claim under her policy with the defendant. 

The plaintiff holds Texas Windstorm Insurance Association responsible because the defendant allegedly failed to accept coverage in full or deny coverage in full within 60 days from the date the claim was made.

The plaintiff seeks all damages, attorney's fees, costs and expenses and such other and further relief to which she is entitled. She is represented by Aaron Bender and Richard D. Daly of Daly & Black PC in Houston.
