F&A Drywall Construction alleged to have failed to pay correct rate for overtime work

HOUSTON – Former laborers for a drywall contracting company allege that they were not paid the appropriate rate for overtime work.

Carlos Marquez, Francisco Perez and Gustavo Rico, individually and on behalf of all others similarly situated, filed a complaint on May 25 in the Houston Division of the Southern District of Texas against F&A Drywall Construction Inc. and Francisco Lopez alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiffs allege that they worked for the defendants from October 2017 to February 2018. They allege they regularly worked in excess of 40 hours per week and did not receive overtime premiums for hours worked over 40. 

The plaintiffs hold F&A Drywall Construction Inc. and Lopez responsible because the defendants allegedly failed to pay its employees the required overtime premium at a rate of time-and-one-half for all work performed in excess of 40 hours per workweek.

The plaintiffs request a trial by jury and seek unpaid overtime wages at the applicable rate, liquidated damages, costs and attorney’s fees and all further relief as the court deems just and equitable. They are represented by Josef F. Buenker and Vijay Pattisapu of The Buenker Law Firm in Houston.
