Children sue cemetery after remains discovered in mother's intended burial space

GALVESTON – Three Galveston County residents are suing a local cemetery and its proprietor for botching the burial of their mother.

Concielette Carter, David Lamb, and Sherlinda L. Bethany filed a lawsuit against Mainland Cemetery & Crematory and Russell LaRoe on May 30 in the Galveston County Court at Law No. 2.

The plaintiffs claim the internment of Marguerite Lamb on May 20, 2017 ended abruptly because the decedent’s intended burial space next to her late husband had the remains of someone else in it.

Court documents say that the woman’s children were able to confirm the problem and were forced to delay the burial for approximately a week while the defendants removed the body in question.

“The defendants’ acts violated the terms of the contract and were done with reckless disregard for the plaintiffs’ suffering and emotional pain during a difficult and trying time in their lives,” the suit says.

Consequently, the complainants seek unspecified monetary damages.

They are represented by W. Clyde Lemon of Houston.
