Man disputes charges arising from treatment for car accident injuries, claims insurance not properly billed

HOUSTON – A local man’s lawsuit alleges North Cypress Medical Center Operating Co. Ltd., doing business as North Cypress Medical Center, and Cypress Emergency Associates, PA misrepresented they accepted his insurance.

In the 8-page suit filed on June 1 in the Harris County 61st District Court, Nathan Lummus disputes the combined $35,808.50 he owes for treatment administered to him by the defendants following a car accident in October 2014.

Court papers show NCMC charged Lummus $34,474.50 while Cypress Emergency sought $1,334.

Lummus asserts NCMC stated on its Web site it accepted his carrier, Blue Cross and Blue Shield of Texas, but the respondents concealed from him that “invoices for medical services for personal injury victims are not submitted on the patient’s health insurance.”

The suit adds that the defendants purportedly refused to invoice health insurance on purpose so they could “file an illegitimate lien in an attempt to collect more money from the patient that it is entitled to under Texas law.”

Consequently, the complainant seeks a declaratory judgment and attorney’s fees.
