SHERMAN – A Collin County man alleges a home improvement store failed to move a pallet out of a walkway that caused him to fall.
Brad Wayne Wohlander filed a complaint on June 7 in the Sherman District of the Eastern District of Texas against Home Depot USA Inc. alleging negligence.
According to the complaint, the plaintiff alleges that on Aug. 10, 2016, he was injured at defendant's Home Depot store in Plano when he tripped and fell over a pallet that extended in the walkway. The plaintiff alleges he sustained severe injuries resulting in physical pain, mental anguish, physical impairment, disfigurement and loss of earnings.
The plaintiff holds Home Depot, U.S.A., Inc., responsible because the defendant allegedly failed to warn its invitees of the existence of the dangerous condition posed by the pallet extending into the walkway and failed to move the pallet out of the walkway.
The plaintiff requests a trial by jury and seeks actual damages, plus costs, prejudgment and post-judgment interest, and such other and further relief to which he may be entitled at law or in equity. He is represented by John L. McCraw III and John C. Ginn of The McCraw Law Group in McKinney.
