Tyler-based content management firm slaps Frontier Communications Corp. with $210M patent infringement suit

TYLER – Locally-based content management & applied security firm Blue Spike, LLC recently slapped Frontier Communications Corp. with a $210 million patent infringement lawsuit.

The 143-page suit, which was filed late last month in the Tyler Division of the Eastern District of Texas, complains that Frontier committed 17 counts of infringement of 12 patents purportedly owned by Blue Spike.

“Blue Spike is a company focused on innovation with research and development,” the original petition says. “Blue Spike does not make a service that competes directly with the defendant, but Blue Spike has licensed its pioneering patents to competitors of Defendant.”

Recent court documents accuse Frontier of making, using, offering for sale and selling products, systems, and/or services including, but not limited to its Business Internet products and services and FiOS TV systems, products and services.

“The defendant has not sought or obtained a license for any of Blue Spike’s patented technologies, the suit says. “This creates a competitive disadvantage to other companies, like Apple, Acer, Dell, IBM, Samsung, and Sony to name some large companies, who recognized the value and novelty Blue Spike’s patents provide to society.”

In addition to the $210 million, the complainant requests a jury trial.

It is represented by the law firm Garteiser Honea PLLC, which has offices in Tyler and San Francisco.
