Lawsuit asserts hospital responsible for patient's fatal fall from bed

HOUSTON – Attorney Elijah Gooden, III has filed a lawsuit against Memorial Hermann Healthcare System on behalf of the estate of a man who reportedly perished in late 2016 while under its care, per recent Harris County District Court records.

Court papers filed on June 11 in the Harris County 127th District Court say that the late Joseph C. Rucker, Jr. was a patient at Memorial Hermann Hospital-Texas Medical Center on Nov. 29, 2016 when he fell out of his bed.

According to the complaint, Rucker suffered blunt force trauma to his head and succumbed to his injury on Dec. 3, 2016.

Rucker’s estate asserts the defendant was negligent in its “duty to guard against the foreseeable consequences of the patient’s injury, condition, and treatment.”

Consequently, it seeks unspecified monetary damages and a jury trial.
