SHERMAN – A Dallas resident claims a debt collection company illegally contacted him to collect an alleged debt.
Brent Harrison filed a complaint on June 12 in the Sherman District of the Eastern District of Texas against Allied Collection Services Inc. alleging that the debt collection company violated the Telephone Consumer Protection Act.
According to the complaint, the plaintiff alleges that in February 2016, he began to receive calls from the defendant attempting to collect on a debt he allegedly owed. He alleges the purposes of the calls were to bully him into paying the balance.
The plaintiff holds Allied Collection Services Inc. responsible because the defendant allegedly continued to make unauthorized calls to plaintiff’s cellphone using an automated telephone dialing system and/or pre-recorded voice messages after he told it to stop contacting him.
The plaintiff requests a trial by jury and seeks statutory damages of $500 for each and every negligent violation, treble damages of $1,500 for each and every willful violation and permanent injunctive relief enjoining defendant from engaging in unlawful calls. He is represented by W. Craft Hughes and Jarrett L. Ellzey of Hughes Ellzey LLP in Houston and Bryant A. Fitts of Fitts Law Firm LLC in Houston.
