Wisenbaker Builder Services owe unpaid overtime wages, former employees allege

HOUSTON – Two former inside sales representatives of a Houston company allege that they were misclassified as exempt from receiving overtime pay.

Valeria Reta and Alexandria Marrujo, individually and on behalf of all others similarly situated, filed a complaint on June 15 in the Houston Division of the Southern District of Texas against Wisenbaker Builder Services Inc. alleging that the former employer violated the Fair Labor Standards Act.

According to the complaint, the plaintiffs allege that during their employment with defendant, they regularly worked in excess of 40 hours per week without receiving proper overtime compensation. They allege they were paid on a salary basis.

The plaintiffs hold Wisenbaker Builder Services Inc. responsible because the defendant allegedly required them to clock out for lunch despite not taking a break, regularly required them to clock out at the end of the day even if they continued working and misclassified them as exempt employees to avoid paying overtime pay.

The plaintiffs request a trial by jury and seek unpaid overtime compensation, liquidated damages, attorney’s fees, prejudgment interest, costs and such further relief that are just and equitable. They are represented by Josef F. Buenker and Vijay Pattisapu of The Buenker Law Firm in Houston.
