HOUSTON – A La Porte homeowner alleges a Harris County contractor did "sloppy work" and that the issues in her home have not been repaired.
Kathy Muston filed a complaint on June 14 in the Harris County District Court against Allied Foundation Specialists Inc. alleging breach of contract and other counts.
According to the complaint, the plaintiff alleges that in July 2016, she fully paid the defendant to level the foundation of her home. She alleges the defendant failed to provide work and materials in conformity with its contractual promises, including a failure to obtain permits and a failure to complete the work in an acceptable and workmanlike manner. She alleges the interior of her house has been damaged and the home now has a termite infestation because the defendant failed to place termite shields.
The plaintiff holds Allied Foundation Specialists Inc. responsible because the defendant allegedly falsely represented to the public that it has the experience and expertise in foundation leveling and foundation repair and breached the warranty by failing to make the necessary and appropriate adjustments to the foundation.
The plaintiff requests a trial by jury and seeks monetary relief between $100,000 and $200,000 and such other and further relief to which plaintiff may be entitled. She is represented by Guy K. Cooksey and Cassandra McGarvey of Sanders McGarvey LLP in Houston.
