Westin Galleria Houston guest alleges elevator door injured foot

HOUSTON – A guest at a Houston hotel alleges he was injured when an elevator door closed on him.

Eduardo Leal filed a complaint on June 19 in the Harris County District Court against Starwood Hotels & Resorts Worldwide LLC alleging negligence and premises liability.

According to the complaint, the plaintiff alleges that on Sept. 22, 2017, he injured his foot at defendant's Westin Galleria Houston when the elevator doors closed suddenly and without warning on his foot, which he was using to keep the door open. He alleges he sustained serious and permanent injuries resulting in pain, disability, mental anguish, loss earnings and medical expenses as a result of his injuries. 

The plaintiff holds Starwood Hotels & Resorts Worldwide LLC responsible because the defendant allegedly negligently allowed a dangerous condition to exist for an unreasonable amount of time and failed to adequately warn its invitees of the existing danger.

The plaintiff seeks monetary relief of more than $200,000 but less than $1 million and such other legal and equitable relief to which he may be entitled. He is represented by Richard Jason Nava of Stern Law Group in Bellaire.
