GALVESTON – A Whitney resident alleges a La Marque auto mechanic failed to replace an engine and will not refund his money.

Robert Galvan filed a complaint on June 21 in the Galveston County District Court against Tim Dill citing the Texas Consumer Protection Act.

According to the complaint, the plaintiff alleges that on Feb. 28, 2017, defendant agreed to replace the eight-cylinder engine in plaintiff's 2008 BMW within one month for the sum of $5,660. He alleges the defendant failed to replace the engine and will not refund the plaintiff.

The plaintiff holds Dill responsible because despite a written demand of his claim on March 9, the defendant allegedly failed and refused to replace the engine and to refund to plaintiff's money.

The plaintiff seeks judgment against the defendant in the sum amount of $10,083.49, with interest, attorney’s fees, costs and such other and further relief to which he is entitled. He is represented by Thomas Cain of Roberts, Johnson & Cain in Texas City.
