HOUSTON – A specialized eye products and care provider is alleged to have failed to pay manufacturing employees at its Houston facility the correct rate for overtime pay.

Mira Horne, individually and on behalf of all others similarly situated, filed a complaint on July 2 in the Houston Division of the Southern District of Texas against Alcon Research LTD alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that she regularly worked more than 40 hours a week for the defendant without receiving overtime compensation for all hours worked in excess of 40 hours. She alleges that instead she was paid straight time only.

The plaintiff holds Alcon Research LTD responsible because the defendant allegedly willfully carried out its illegal pattern and/or practice of failing to pay overtime compensation.

The plaintiff requests a trial by jury and seeks an order recognizing this proceeding as a collective action and appointing plaintiff and her counsel to represent the class members, award for all unpaid wages and overtime compensation, attorney’s fees, costs, and expenses and such other relief as to which she may be entitled. She is represented by Chris R. Miltenberger of The Law Office of Chris R. Miltenberger PLLC in Southlake.
