Injured worker alleges Triad Control Systems failed to barricade hole

HOUSTON – A worker alleges he was injured while on a Houston job site because a hole was not barricaded or marked with safety signs.

Martin Rodriguez filed a complaint on July 3 in the Houston Division of the Southern District of Texas against Triad Control Systems Inc. alleging negligence.

According to the complaint, the plaintiff alleges that on July 2, 2016, he was working at the Flint Hills Resources plant in Houston as an employee of CIMA Services and was injured when he stepped on a bundle of wires, lost his balance, and fell into a hole approximately 4-feet deep. He alleges the wire bundle was left on the ground by the defendant and the defendant also dug and maintained the hole.

The plaintiff holds Triad Control Systems Inc. responsible because the defendant allegedly negligently left the bundle of wires on the ground and failed to barricade the hole and failed to provide safety signs or warning of the existing danger.

The plaintiff requests a trial by jury and seeks monetary relief of no less than $75,000 and such other and further relief allowed by law and equity. He is represented by Gregory L. Gowan and Christopher A. Garza of Gowan Elizondo LLP in Corpus Christi.
