Man seeks $1 million from Cypress Gardens after fall from ladder while tree trimming

HOUSTON – A Harris County man alleges he was injured when a ladder fell while he was trimming trees on a Houston property.

Jimmy Cosey filed a complaint on July 10 in the Harris County District Court against Capstone Real Estate Services Inc., doing business as Cypress Gardens, alleging negligence.

According to the complaint, the plaintiff alleges that on June 12, he was trimming hedges at defendant's property on Crosby Freeway in Houston. The suit states an employee of the defendant instructed him to place a ladder against a light pole and cut tree branches. He alleges the ladder fell while he was cutting the branches, causing him injury.

The plaintiff holds Capstone Real Estate Services Inc. responsible because the defendant allegedly negligently hired and trained the employee who directed him to use the unsecured ladder.

The plaintiff requests a trial by jury and seeks monetary relief of more than $1 million and such other and further relief to which he is entitled. He is represented by Michael S. Tilton and Jason A. Caston of Tilton & Tilton LLP in Houston.
