Kansas City Southern Railway worker alleges failure to provide equipment caused shoulder injury

BEAUMONT – A railway worker alleges an unsafe work environment caused him to injure his shoulder.

Bryan A. Smith filed a complaint on July 6 in the Jefferson County District Court against The Kansas City Southern Railway Co. alleging negligence.

According to the complaint, the plaintiff alleges that on Feb. 22, he was injured while in the course and scope of his employment with defendant while changing out grinding shoes on a locomotive. He alleges he suffered serious injuries to his right shoulder, right arm, right hand, right elbow and other parts of the body. 

The plaintiff holds The Kansas City Southern Railway Co. responsible because the defendant allegedly failed to provide safe and suitable equipment, failed to provide adequate manpower and failed to provide adequate training and supervision.

The plaintiff seeks judgment against the defendant in a sum within the jurisdictional limits of the court, with interest costs and such other and further relief to which he may be entitled. He is represented by Bristol Baxley of Rome, Arata & Baxley LLC in Pearland.
