Former patient of Beaumont podiatric physician alleges permanent injuries because of breach of care

BEAUMONT – An alleged breach of care from a Beaumont podiatric physician is alleged to have caused permanent injuries for a patient.

Kevin Swearingen filed a complaint on June 27 in the Jefferson County District Court against James Bruyn, DPM alleging breach of the standard of care.

According to the complaint, Bruyn diagnosed the plaintiff with stress fractures in several toes in his right foot in March 2016 and did not place the plaintiff under any restrictions. The plaintiff alleges that because he was still experiencing pain, he sought a second opinion in July 2016 and was informed his problem could not be reversed and he needed surgery. The plaintiff alleges he now walks with permanent limp and has been unable to wear normal shoes on his right foot. 

The plaintiff holds Bruyn responsible because the defendant allegedly failed to offload his fractured foot.

The plaintiff seeks judgment against the defendant in the amount exceeding the jurisdictional limits of the court, with interest and costs and such other and further relief to which he may be justly entitled. He is represented by Collin D. Cobb of The Monk Law Firm in Beaumont.
