Woman alleges Shared Financial Services OP failed to return money meant to pay lien

HOUSTON – A Houston woman alleges a financial services company misrepresented that she needed to pay a lien on a property she wanted to purchase.

Eliza Faye Clinton filed a complaint on July 18 in the Harris County District Court against Shared Financial Services OP I LLC and Michael Graham alleging that they violated the Deceptive Trade Practices Act.

According to the complaint, the plaintiff was a prospective buyer of a 10620 Homestead Road, Houston property in May and agreed to the initial terms of an agreement with the defendants for a construction loan and other costs for the property.

The suits states the defendants later informed her that a $28,500 lien was on the property that needed to be paid before she could buy it, so she forwarded that amount to the defendants to pay it. She alleges she was later informed that the current owner paid the lien and that the defendants have not returned her money.

The plaintiff holds Shared Financial Services OP I LLC and Graham responsible because the defendants allegedly made misrepresentations and omissions of fact regarding real estate investment opportunities.

The plaintiff requests a trial by jury and seeks actual and punitive damages, attorney's fees, costs and such other relief to which he is entitled. She is represented by Chukwudi Egbuonu of Law Office of Chukwudi Egbuonu in Houston.
