Eye clinic blamed for patient's post-appointment fall

HOUSTON – A Harris County man is suing an eye clinic over an alleged fall at its facility.

Regis Toomey filed a lawsuit against HEA Clinic P.A., doing business as Houston Eye Associates, on July 23 in the Harris County 80th District Court. Toomey says the Oct. 4, 2017 incident occurred when he was leaving the clinic following an appointment.

According to the suit, the defendant dilated the plaintiff’s eyes as part of his evaluation.

“After completing his evaluation, Mr. Toomey was escorted to the front desk and permitted to leave the premises without being advised of the impeding sensitivity to light,” court papers say. “While Mr. Toomey exited the building, he fell from the sidewalk.”

Toomey reportedly injured his shoulder, neck, and head.

Consequently, the complainant seeks unspecified monetary damages.

He is represented by Jeffrey N. Todd of The Todd Law Group, PLLC in Houston.
