Woman alleges fall because of barrier in Kelsey-Seybold Clinic parking lot led to blindness in eye

HOUSTON – A Harris County resident alleges she fractured her orbital bone after a fall in a Houston parking lot that led to blindness in one eye.

Dicy Bolivar filed a complaint on July 20 in the Harris County District Court against Kelsey-Seybold Medical Group PLLC, doing business as Kelsey-Seybold Clinic, alleging negligence.

According to the complaint, the plaintiff alleges that on Dec. 4, 2017, she was an invitee at defendant's premises in Houston when she tripped over a concrete parking block in the walkway of the parking lot. She alleges she fractured her orbital bone in the fall, which led to blindness in her right eye.

The plaintiff holds Kelsey-Seybold Medical Group PLLC responsible because the defendant allegedly negligently permitted the parking lot to remain in a dangerous state and failed to give warning of the existing danger.

The plaintiff requests a trial by jury and seeks monetary relief of more than $1 million and such other and further relief to which she is entitled. She is represented by Michael S. Tilton and John A. Caston of Tilton & Tilton LLP in Houston.
