Patient's suit takes issue with placement of hospital liens

HOUSTON – A Harris County woman has pursued legal action after two medical entities purportedly refused to bill her insurance carrier.

Barbara Bahm filed a lawsuit against Memorial Heights Emergency Center, LLC and Emergency Medicine Physicians of Texas, PLLC in the Harris County 295th District Court on July 27.

Though Bahm “signed an irrevocable assignment of benefits” to the effect the respondents accepted her coverage as payment, the 6-page suit states, the latter declined and “provided deficient notice they intended to file liens.”

Two hospital liens were reportedly filed against the plaintiff.

“The liens, though typically allowed under the law, are invalid or unenforceable because the defendants refused that method of recovery at the time they accepted the plaintiff’s insurance as payment for the treatment given to the plaintiff,” court papers say.

Consequently, Bahm seeks unspecified monetary damages.

She is represented by David K. Mestemaker, Norman Straub, and Codi D. Kraus of the law firm Mestemaker & Straub in Houston.
