Individual alleges lien on Houston property is fraudulent

HOUSTON – A Harris County resident alleges a lien placed on a Houston property is fraudulent.

Thomas E. Wallace filed a complaint on July 26 in the Harris County District Court against Edelano Damone Long, individually and doing business as Denker, Brighton & Browning, alleging trespass to try title and fraudulent lien.

According to the complaint, the plaintiff alleges that when attempting to sell his Sweetwater Lane, Houston property in early 2018, he discovered that defendant filed a mechanic's lien against his property in 2012. Due to the lien, he alleges he cannot sell the property as the title is clouded and that the lien was a trespass to try title.

The plaintiff alleges the lien is fraudulent and that the defendant is barred from claiming title to the property.

The plaintiff requests a trial by jury and declaration that the defendant's lien is invalid, interest and attorney's fees. He is represented by Nickolas A. Spencer of Spencer & Associates PLLC in Houston.
