SAN ANTONIO – An ambulance service is alleged to have failed to pay former workers the correct premium for overtime work.

Zachary Ellis, Gregory Westover and Megan Camden, individually and on behalf of all others similarly situated, filed a complaint on July 26 in the San Antonio Division for the Western District of Texas against Viking Enterprise Inc., doing business as City Ambulance Services, and Mohamad Massoud alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiffs were employed as emergency medical technicians/paramedics for the defendants and regularly worked more than 40 hours per workweek. They allege they were misclassified as independent contractors instead of employees.

The plaintiffs hold Viking Enterprise Inc. and Massoud responsible because the defendants allegedly failed to pay them at a rate of time-and-one-half of their regular rate of pay for overtime work.

The plaintiffs request a trial by jury and seek all unpaid wages, liquidated damages, attorney's fees, costs, interest and such other relief to which they are entitled. They are represented by Michael V. Galo Jr. of Galo Law Firm PC in San Antonio.
