Former tenants of Galveston property allege it had mold issues, broken appliances

GALVESTON – A Galveston County couple alleges that a property they rented had mold and other issues that their former landlords failed to correct.

Ronald Petersen and Julie Petersen filed a complaint on Aug. 3 in the Galveston County District Court against the defendants alleging that they violated the Deceptive Trade Practices - Consumer Protection Act.

According to the complaint, the plaintiffs allege that on September 2017, they selected defendants' Galveston property to be their new home. After they signed the lease, they allege they discovered that defendants misrepresented the condition of the home and found issues with urine-soaked carpets, leaks, mold and broken appliances.

As a result, they allege they were forced to obtain mold inspector and home inspector, who found 84 major deficiencies in the structural system. They allege the new furniture they purchased at a cost of $20,000 was contaminated with mold and they were not able to keep it when they moved out.

The plaintiffs hold Daugherty and Bryan responsible because the defendants allegedly failed to provide a clean and safe place to live and refused to make any repairs in the property.

The plaintiffs request a trial by jury and seek monetary relief of more than $100,000 but less than $200,000 and such other and further relief to which they may be entitled. They are represented by David J. Sadegh of Perry & Shields LLP in Houston.
