ASAP Freight Systems driver alleges he was underpaid

HOUSTON – A driver for a Houston freight company alleges he was underpaid.

Robert Patrick McGuire filed a complaint on Aug. 6 in the Harris County District Court against ASAP Freight Systems Inc., Marek Menger, Sherry Menger and Greg Chapman alleging conspiracy, fraud and breach of contract.

According to the complaint, the plaintiff alleges that in February, he entered into a contract with defendants to transport materials with the use of his truck as an independent contractor. He alleges the defendants underpaid him and did not disclose the true invoiced amount to customers so he could not calculate the amount he was entitled to under his contract.

The plaintiff holds ASAP Freight Systems Inc., Marek Menger, Sherry Menger and Chapman responsible because the defendants allegedly underpaid divers and did not produce invoices that would disclose the underpayment.

The plaintiff requests a trial by jury and seeks damages of less than $200,000, with interest, costs and such other and further relief to which he is entitled. He is represented by Patrick O'Hara of O'Hara Law Firm in Houston.
