Advertising Higher labor alleges he is owed unpaid wages for overtime work

HOUSTON – A laborer employed by a Montgomery County advertising and sign making company alleges that he was paid the same rate regardless of the amount of hours he worked.

Michael Cossey filed a complaint on Aug. 8 in the Houston Division of the Southern District of Texas against Advertising Higher Inc. and Ron Francois alleging violation of the Fair Labor Standards Act.

According to the complaint, the plaintiff alleges that between July 2015 and July 9, 2018, he regularly worked between 50 and 85 hours each workweek for the defendants without receiving any additional premium for all hours worked in excess of 40 hours per week. 

The plaintiff holds Advertising Higher Inc. and Francois responsible because the defendants allegedly failed to compensate him at a rate of no less than one-and-one-half times his regular rate of pay for each hour worked in excess of 40 in a workweek.

The plaintiff requests a trial by jury and seeks unpaid wages, liquidated damages, plus interest, attorney’s fee and costs and such other relief as the court may find proper. He is represented by Charles L. Scalise and Daniel B. Ross of Ross Law Group in Austin.
