GALVESTON – A subcontractor is seeking payment from two bond issuers after it allegedly was not paid for work on a construction project.

Brand Electric Services Inc. filed a complaint on Aug. 9 in the Galveston County District Court against Zurich American Insurance Co. and Colonial American Casualty and Surety Co. citing sworn account.

According to the complaint, the plaintiff was a subcontractor on a construction project known as Newport on the Bay at Marina Riverbend. In December 2017, the plaintiff alleges it completed its work and notified the general contractor of its claim for payment totaling $128,842.40, which is now allegedly overdue and still owed.

The suit states the general contractor procured a payment bond from the defendants.

The plaintiff seeks damages in an amount of $128,842.40, attorney's fees, costs and interest. It is represented by Paul K. Browder and John P. Ferguson of Blazier, Christensen, Browder & Virr PC in Austin.
