GC Services alleged to have unlawfully failed to state call was from debt collector in voicemail

HOUSTON – An Arkansas consumer alleges a Houston debt collector failed to identify the nature of its call in a voicemail.

Angela Mensah filed a complaint on July 30 in the U.S. District Court for the Southern District of Texas against GC Services LP alleging that the debt collector violated the Fair Debt Collection Practices Act.

According to the complaint, the plaintiff alleges that on Aug. 10, she received a collection call from the defendant seeking and demanding payment for an alleged consumer debt. The suit states the defendant left a voicemail on her machine and failed to meaningfully disclose its name, the nature of the call, or state the call was from a debt collector.

The plaintiff holds GC Services LP responsible because the defendant allegedly used false, deceptive and misleading means in connection with attempting to collect an alleged debt by not identifying the purposes of its phone calls.

The plaintiff requests a trial by jury and seeks statutory damages of $1,000, attorneys’ fees, costs and such other and further relief as may be just, proper and equitable. She is represented by Peter Cozmyk of Cozmyk Law Offices LLC in Independence, Ohio.
